THIS GIVEAWAY IS OPEN ONLY TO LEGAL UNITED STATES RESIDENTS of 49 STATES, RHODE ISLAND RESIDENTS AND PUERTO RICO RESIDENTS ARE PROHIBITED FROM ENTERING THIS GIVEAWAY All Federal, State, Local, and Municipal Laws and Regulations Apply. 1. Eligibility

 

The Summersalt® Underwear Giveaway (hereinafter the “Giveaway”) is only open to legal residents of 49 United States and the District of Columbia who are at least 18 years old at the time of entry. Residents of the Rhode Island and Puerto Rico are prohibited from entering this Giveaway. Employees of Sponsor and other companies associated with the promotion of the Giveaway, and their respective parents, subsidiaries, affiliates and advertising and promotion agencies as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. The Giveaway is subject to federal, state, and local laws and regulations. Void where prohibited. Each entrant agrees that the Sponsor, its affiliates and its agents and employees shall not be liable for injury, loss or damage of any kind resulting from participating in this promotion or from the acceptance or use of any prize issued. Sponsor reserves the right to verify eligibility qualifications of any winner.

 

2. Sponsor

 

The Giveaway is sponsored by Summersalt, Inc. (“Summersalt”), located at 911 Washington Ave., St. Louis, Missouri, 63101,  www.summersalt.com. Summersalt shall be referred to as the “Sponsor” of this Giveaway.

 

3. Agreement to Official Giveaway Rules

 

Participation in the Giveaway constitutes the entrant’s full and unconditional agreement to and acceptance of these Official Giveaway Rules (“Official Giveaway Rules”) and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon being compliant with these Official Giveaway Rules and fulfilling all other requirements set forth herein or as might be required by Sponsor when it issues the prize.

 

4. Giveaway Period

 

The Giveaway begins on Monday, February 4, 2019 at 9:00 AM EST and ends on Monday, March 4, 2019 at 5:00 PM EST (the “Giveaway Period”). Entries that are submitted before or after the Giveaway Period will be disqualified. Submissions will be accepted for the duration of the Giveaway at the online site and via mail, as provided below.

 

5. How to Enter

 

Online: This method of entry will be available by one entrant visiting www.summersalt.com/underwear. and entering his or her email address as well as at least three friends’ email addresses. A minimum of three friends’ of the original entrant must also enter the Giveaway by using the original entrant’s unique URL in order to qualify the original entrant to receive a prize.

 

Via the Unique URL: Each entrant will receive a unique URL that can be shared to promote the Giveaway to the entrants’ friends and family. When an entrant’s friend or family member enters the Giveaway by clicking through the unique URL, the entrant who generated the unique URL will have that friend or family member’s email count towards the minimum of three required to receive a prize.

 

Via US Mail: This method of entry will be available for the entire Giveaway Period. On a 3x5 card, handprint your full name, complete address, phone number (including area code) date of birth and e-mail address, and mail the 3x5 card, in an envelope with proper postage affixed to: 911 Washington Ave., St. Louis, Missouri 63101, Attention: Giveaway Entry. Mail-in entries must be hand-printed and mailed in separately. All mail-in entries must be received by March 4, 2019.

 

 For each entry for a chance to win, an entrant will complete and submit the form where the entrant is asked to provide certain information, including the entrant’s name and email address. Each entrant who enters electronically will receive a unique URL that can be shared to promote the Giveaway to the entrants’ friends and family. Limit one initial entry per person, per customer, per e-mail address, and per household for the duration of the Giveaway Period. Entries received from any person, e-mail address, or household in excess of the stated limitation will be void. All entries become the property of Sponsor and will not be acknowledged or returned.

 

6. Conditions of Entry

 

Eligible entrants must enter via one or more of the online methods or US mail method as described. Incomplete entries are void. Any entry by a resident of Rhode Island or Puerto Rico is void. By entering, entrants acknowledge compliance with these Official Giveaway Rules, including all eligibility requirements. E-mail address supplied to Summersalt must be valid and associated with persons other than the original entrant. In order to receive a prize, the entrant must provide his/her own valid email address plus have at least three additional friends/family confirm their e-mail addresses via the Summersalt website at www.summersalt.com/underwear. More than three additional family/friends’ e-mail addresses will not increase the chances of receiving a particular prize and the original entrant will still only receive one prize. The Sponsor is not responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any Web site or online service, or any other error or malfunction, or late, lost, postage due, illegible or misdirected entries. Entry materials that have been tampered with or altered are void. No copies, facsimiles or reproductions of official entry forms will be accepted. You are solely responsible at your sole cost and expense for creating backup copies and replacing any content you post or submit through Sponsor’s Facebook page. You agree that under no circumstances will Sponsor be liable in any way for any loss or damage to any content you post, e-mail, or otherwise make available to Sponsor.

 

 

7. Potential Prizes

 

One of the following prizes will be awarded to each of the eligible entrants, one prize per person, and each prize will be issued in the order set forth below, until the supply of each garment runs out:

 

Summersalt® underwear, with a retail value of $15.00 each; then

 

Summersalt® bralette, with a retail value of $18.00 each, then

 

Summersalt® gift card, with a retail value of $15.00.

 

8. Prize Fulfillment

 

On or before April 30, 2019 (but in no event before March 4, 2019), the Sponsor will issue one free pair of Summersalt® ribbed underwear or a Summersalt® bralette (in each case as supplies last) to each original entrant who provides a valid email address and has a minimum of three friends enter the Giveaway Only one prize will be issued per person. Summersalt will honor the preferred size selected by the entrant as long as supplies last. The color of the underwear or bralette will be at Summersalt’s discretion. No substitution or transfer of prizes is permitted unless an item is not available or delivery is not possible (for any reason or no reason) to the address of the potential winner. Sponsor shall be entitled to substitute the item with a comparable replacement product with the same or better features or a gift card for future use in the amount of the prize the recipient would have received if supplies lasted. Summersalt will cover the cost of shipping & handling to any address within the continental United States, however, addresses in AK or HI may require additional shipping & handling. Any taxes on prizes won will be the sole responsibility of the winner.

 

Throughout the Giveaway Period, each original entrant will receive a prize by achieving entry milestones described in these Official Giveaway Rules and while supplies last. The chance of receiving a prize depends on the number of entries received.

 

9. General Conditions

 

In the event that the operation, security, or administration of the Giveaway is impaired in any way for any reason, including, but not limited to fraud, virus, bug, worm, unauthorized human intervention or other technical problem, or in the event the Giveaway is unable to run as planned for any other reason, as determined by Sponsor in its sole discretion, the Sponsor may, in its sole discretion, either (a) suspend the Giveaway to address the impairment and then resume the Giveaway in a manner that best conforms to the spirit of these Official Giveaway Rules or

terminate the Giveaway and, in the event of termination, award the prizes at random from among the eligible, non-suspect entries received up to the time of the impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Giveaway or to be acting in violation of these Official Giveaway Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to damage the website or undermine the legitimate operation of the Giveaway may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages (including attorneys’ fees and costs) and any other remedies from any such person to the fullest extent. Failure by the Sponsor to enforce any provision of these Official Giveaway Rules shall not constitute a waiver of that provision.

 

10. Release and Limitations of Liability

 

By participating in the Giveaway, entrants agree to release and hold harmless the Sponsor, and each of its respective parents, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with the Giveaway, and each of their respective officers, directors, employees, judges or entrant counters, shareholders, representatives, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Giveaway or receipt or use of the prize, including, but not limited to: (a) any technical errors associated with the Giveaway, including lost, interrupted or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (b) unauthorized human intervention in the Giveaway; (c) mechanical, network, electronic, computer, human, printing or typographical errors; (d) application downloads, (e) any other errors or problems in connection with the Giveaway, including, without limitation, errors that may occur in the administration of the Giveaway, the announcement of the prize recipients, the cancellation or postponement of the Giveaway, if applicable, the incorrect downloading of the application, the processing of entries application downloads or in any Giveaway-related materials; or (f) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from entrants participation in the Giveaway or acceptance, receipt or misuse of the prize (including any travel or activity related thereto). Entrant further agrees that in any cause of action, the Released Parties liability will be limited to the cost of entering and participating in the Giveaway, and in no event shall the entrant be entitled to receive attorneys’ fees or other related costs. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Giveaway. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

 

11. Disputes

 

Except where prohibited, each entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Missouri. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Giveaway Rules, entrants rights and obligations, or the rights and obligations of the Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of Missouri, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than Missouri.

 

12. Use of Entrant Information by Sponsor

 

By entry into this Giveaway, each Entrant consents to the use of the Entrant’s name, identity, photograph, and any photo or video submission (if applicable) for promotional purposes, including online announcements, without additional compensation, except where prohibited by law, even if such Entrant’s submission is not selected as a winning submission for this Giveaway. If the Giveaway is terminated prior to the end of the stated entry period, notice will be posted at  www.summersalt.com/underwear, through e-mails, and on Sponsor’s website, Sponsor’s Facebook page, and Sponsor’s Instagram page. Any attempt to deliberately damage the content or operation of this Giveaway is unlawful and subject to legal action by Sponsor and/or its agents. To request the name of the prize recipients send a self-addressed stamped envelope to 911 Washington Ave., St. Louis, Missouri 63101. Prize recipient requests will only be accepted after the promotion end date (stated above). For the prize recipient list, you can also send an e-mail. Requests received after one month past notification date will not be honored.

 

 

13. Privacy Notice

Entrants should read Summersalt’s Privacy Policy, located at: www.summersalt.com/pages/privacy-policy. By entering this Giveaway, entrants may receive marketing materials, communications and other materials from the Sponsor and affiliated or other companies whose products and services the Sponsor feels might interest entrants at a future date. An entrant not interested in receiving this material, should send an email to hello@summersalt.com to notify Sponsor of entrant’s desire not to receive such materials.
